In this episode, Jamie and Eli Baumwell (ACLU-WV Policy Director) give an update on what the ACLU-WV has been up to. We talk about DACA, ICE raids and arrests, your rights during an ICE raid, “nuisance” ordinances proliferating around West Virginia, writing angry FOIA requests, federal judges writing footnotes about Dr. Evil, and more.

Remember: you DO NOT have to show your papers to ICE agents who ask. Simply ask if you are free to leave.
Recuerda: no tiene que mostrar sus papeles a los agentes de ICE, aunque te pregunten. Tranquilamente pregunte a el agente si está libre para irse.

If You are a DACA recipient, please read:

On September 5, 2017, President Trump rescinded the June 2012 Deferred Action for Childhood Arrivals (DACA) Memorandum to begin phasing out the DACA program. Almost 800,000 DACA recipients will be affected. Those whose status expires before March 5, 2018 are eligible to renew, but must do so before October 5, 2017.  If you or someone you know is a DACA recipient, please contact Catholic Charities West Virginia Migration and Refugee Services at (304)267-3071 (Martinsburg) or (304)343-1036 (Charleston)  for assistance with renewal or a consultation to evaluate if other immigration options are available to you.  You may also contact an immigration attorney or Board of Immigration Appeals accredited representative.

Here is a link to the New York Times editorial that Bob Murray somehow believes is defamatory. And remember: you still have a constitutional right to tell Bob to eat sh*t, no matter what his lawyers say. (Side note from Jamie: they actually included one of my tweets as an exhibit to a brief, which I think might be the coolest thing ever.) And here is a link to Judge Bailey’s order in the Bob Murray/John Oliver saga. (Judge Bailey’s has a pretty great footnote on page 7. #justsayin)

Since recording this episode, we also received a response to the FOIA request from Clay County Schools. You can also check out the original FOIA requests we sent to Clay County Superintendent and the Clay County Sherriff.
