ACLU-WV Policy Director, Eli Baumwell, spoke at a public hearing against HB 2114 – a bill that would limit the number of delegates to an Article V constitutional convention. This bill is a follow-up to a concurrent resolution passed in 2016 calling for an Article V convention. HB 2114 is problematic for a number of reasons, but chief among them is that it’s a constitutionally suspect prior restraint on free speech. Simply put, the bill is bad policy. We’re urging the Legislature to reject this bill and pass Concurrent Resolution 81 that rescinds the initial call for a convention.
