CHARLESTON, W.Va. – News media are invited to attend and cover a hearing where WV Citizens Action Group, represented by the ACLU of WV, will ask Judge Richard Lindsay to grant a temporary restraining that would put an end to the current deployment of the West Virginia National Guard to Washington D.C..

“As an organization with over 50 years of advocating and organizing West Virginians for accountability, justice, and good governance, we believe that the use of West Virginia’s National Guard troops in this context is a clear misuse of power,” said WV CAG Executive Director Dani Parent. “The Guard exists to serve West Virginians in times of crisis, not to be deployed on the whims of politicians.”

ACLU-WV Legal Director Aubrey Sparks said that neither state law nor the U.S. Constitution permitted the deployment of the West Virginia National Guard in this instance. "The Guard’s services are indispensable to West Virginia, and sending these vital resources out of state for political reasons by the president is unprecedented, unconscionable, and unlawful."

The hearing begins at 9:30 am Friday, October 24 and will be held on the 5th floor of the Kanawha County Judicial Annex Building (111 Court St, Charleston, WV).
